Dumping of rubbish - private ground

    As an aside from one or two threads here

    Hypothetical scenario

    Person A dumps say a bag of rubbish on the private property of B

    B is a natural person and not a public body etc.

    Does A:

    i) commit any dumping/litter related offence?

    ii) commit any other offence (possibly trespass or nuisance)?

    Is that the test as to whether it is an offence or not?

    For sake of argument assume in one case it is visible and another it is not.

    If its not visible from a public place the Litter Pollution Act is pretty powerless.
    The waste management act gives the householder 6 months to store the same bag.
    If the scenario changes ie rats appear or the contents of the bags/rubbish are finding themselves ending up in view from a public place the incident may be revisited.

    I see. However, in these cases person B would be the unwitting offender

    However, does person A in dumping rubbish unto the private property of B actually commit any dumping/litter offence?
