ok so the situation was that i was doing an internship which started 2 weeks ago. The internship was advertised on JobBridge as office work ect. i went into the workplace and after all was said i got the internship and he asked me did i have equip...i said yeah and he asked me to bring them in when i start......i was doing trade work (have had exp in the past didn't mind doing it too much in the internship but felt a bit overworked for extra 50e). anyway i hurt my back Wednesday working on a job...complained about it to the boss and again Thursday....eventually the pain got so bad the thurs i had to ask wifey to collect me and went docs fri morn....turned out it was a torn muscle....then today when i went in to show him sick cert and explain i could be out for few weeks the boss asked me to collect to equip and he didn't need me anymore and said we'll just leave the jobbridge internship but he wont tell them if i don't (i have no intention hiding it from them)

just looking for advice...do i go legal or what?

well i don't know the ins and outs of JobBridge like does it count as unfair dismissal still?...i was told by someone else an employer cant ask certain types of work on internships and various other types of labour.....

so was looking to get input for what i should do so when monday comes i'll have an idea where i stand.

I'm really confused at what you're trying to achieve here. Just tell them this one didn't work out and get another one when you're better. You'll need to tell the social you need to go onto sickness benefit while you're laid up.

I think he feels he was unfairly sacked because of his injury (which happened at work).
Would I be right that he was not directly employed by the garage?

I doubt he has any recourse but he played along with being hired for one thing and then doing another. Just move on imho. (Well other than going through the PIAB)

yes that is how i feel as when i injured myself doing work i wasn't supposed to while on job bridge he didn't want me there after that....i didn't know i wasn't supposed to be doing any type of labor work until today and i told him i wasn't happy doing it....

so i guess what i'm saying is i was injured in work and unfairly dismissed by an employer because i got injured while he took advantage of the internship program and i am the one left to suffer.

also i cannot just change a job bridge program as you can only apply for one every 9 months

but my question is would this condone legal action?

You have a choice between agreeing to say nothing as long as he doesn't report that you're no longer coming in.
Alternatively you could claim for injury at work against him but you would have to report that you aren't working... and lose the €50 per week.

well i'm pretty sure i'll make a solicitor appointment for a claim but the part that annoys me the most is that he seen i was injured and just basically gave me the sack.....and being exploited and taken advantage of also

Come clean with the social immediately. Then, consult a good solicitor

Doubtless your former employer will try and shaft you for the €50 per week too.

Re Jobbridge - It is not the end of the world. It may be that technically only one Jobbridge 'job' can be applied for every nine months.

However, there are extenuating circumstances in your case to put you on another one (if you are able, given the disability)

Pain and suffering for a poxy E50 a week? Sod that for a laugh. It's not worth it IMO. We all want to work, but we don't want to work at any cost. This is your health we're talking about OP.

I would keep it straight. Go back to Welfare, tell them what happened and claim the sickness benefit. If you want to pursue the claim, then speak to a solicitor as well.

As said, you need to inform the social immediately of what has happened. .

That also includes telling them the actual work on the internship was completely different from that advertised.

Do not be afraid to tell them. You have ended up injured n a State run Jobbridge course

There is a central office in Edenderry as far as I know, which handle Jobbridge.

They certainly claim to be interested in stamping out any 'wrongdoing' on the part of the employer. If by reporting the employer they actually will remains to be seen.

Do you still have a copy of the original 'ad' for the internship. Find it and keep it.

thanks for the replies...going solicitor monday (a very well known and very good one)

i will be reporting it to social and will go about it through all the right channels....

just a shame that there doesn't seem to be much decency left in this day and age.....i like to work and sure this crack would seriously put a downer on anyone....a joke it is...
