Car has not scrapped by dealer

    I am looking for a little advise, we bought a new car and traded an old unit on the basis it would be scrapped.
    I have heard today that four months later it is driving around and a quick check with the motor reg office shows that the car is still registered to us and tolls have been paid on it. The dealer is claiming the car was scrapped but funnily enough cant provide a cert.

    what do we do?

    You don't 'trade' an old car on the basis that it will be scrapped, you give to an authorised treatment facility and get a certificate of destruction, otherwise you only have yourself to blame if the car is still on the road. I realise the dealer told you he would 'take it off your hands' but that was the lazy way out.

    Consider yourself lucky that the new owner is actually paying the motorway tolls but you mightn't be so lucky if he picks up a parking ticket and doesn't pay it.

    Write to the people in Shannon, give the name of the dealer and say he accepted it as a trade-in.

    Get off your high horse it's clear the car was traded in under the scrapage scheme.

    OP it's not the first time I've heard of this but I don't know who you should go to about it

    Coylemj, it was traded under the scrappage scheme, but thanks for the useless advise.

    @megafan, The toll guys have told us it is the same model car.

    The scrapage scheme that no longer exists?
    It was still being offered up until recently as the OP has just confirmed with certain brands.

    I'd contact Shannon as they have done but also possibly it may be worth contacting the dealer in question in writing demanding the ownership be transferred by them

    Only the government backed scrappage scheme requires the car to be scrapped. Any dealer offers are just marketing gimmicks.

    It couldn't be still on the road if it was traded under the Govt. scrappage scheme. When you gave the car to the dealer what did you do with the registration cert?

    If it was a dealer 'scrappage' scheme then alarm bells should have rung if the dealer asked for the registration cert., that should have alerted you to the fact that he was going to sell it on.

    If he is a main dealer and it was a manufacturer scrappage scheme then write to the distributor as well as Shannon and say that you handed over the car believing it was going to be scrapped but it's now back on the road.

    OP, go to the garage and insist that they arrange a change of ownership from you to the new owner. Most garages have the facility to do this online with the Vehicle Registration unit.

    If they won't do this, then get them to complete an RF105 form.

    The RF105 allows the garage to list themselves as a "garage owner" without adding to the number of previous owners of the car. If you end up having to complete the RF105, get them to complete it, and send it off to the Vehicle Registration unit in Shannon yourself.
    Make sure you put the Date of Sale in as the date you gave them the vehicle.

    That would be a serious mistake because if the cops stop the car and arrest the driver on suspicion of taking the car without the owner's consent, the OP could be sued in the civil courts by the new owner and the Gardai could also prosecute him in the criminal courts for falsely reporting a crime which never happened.

    The OP no longer owns the car, it makes no odds whose name is on the registration cert. If the guy now driving the car paid over cash in a bona fide transaction then the OP has no beef with him and he (the new owner) is entitled to drive the car without any interference. The fault lies with the dealer, not the guy now driving the car.

    I have just received a form from Shannon that allows me make a declaration that this car was handed over to the dealer it also prevents me having to deal with them.

    They have the log book, I cant say I knew any better I presumed that the log book would have to be used as part of the scrap process (the car was not roadworthy).

    We got a discount worth a lot more than the cars worth if he wanted to sell it on, I would have had no issues. It was the fact he told us after the deal it was scrapped and yet the car is still on the road registered to us, I would expect more from a main dealer.

    I wouldn't trust many main dealers to fill my washer bottle.
    SIMI and Main dealer means nothing in terms of trustworthyness.

    Even then, theres nothing stopping the car staying on the road. It just means the dealer doesn't get the VRT rebate. If the customer gets the car they wanted for the price I don't see what the issue is if the car was useable and stays on the road (assuming its not left in the customers name)

    The only 'scrappage' scheme that required cars to be scrapped officially was the government backed one which ended in June 2011.

    Anything after that was just dealers/suppliers using the name to help continue sales. The discounts offered where by the dealers themselves, not any VRT rebait or similar so there was never any guarantee that the car would be scrapped. It should certainly have been put in the dealers name if they are using it though as it sounds like they may be using it as a run around or a loan car etc.
