Clamped by NCPS on public road

    Hi all,

    Have been clamped by NCPS on a public road (well the wheel that was clamped is on a public road, the rest of the car is in a NCPS enforced parking bay)

    What are the options open to me here?

    Does anybody have the loan of a bolt cutters I could use in Dublin?

    You'll need a 42" bolt cutters to get through it (so I've been told ;))

    Whatever you do don't pay them, come back tomorrow remove the clamp and take it home as a present.

    I don't think there is much you can do,they are required to clamp on drivers side(serious amount of people were clamped on passenger side didnt notice and drove causing damage which they sue the clamping companies for damage and all won) for some reason I don't think you could pull it off..
    There is a legal forum on boards might be of more help(its really more legal than motoring

    A mates got clamped 120e to release so he got a tow truck to bring it 3miles back home for 40e and cut clamp off

    SD, take the advice above, see how much a tow would cost you, do not pay a cent to NCPS, what they do is illegal end of.

    If its not an official dublin city council clamp I would just take it off.

    Their is no legel basis for a non dublin city council clamper to clamp you.

    You will probably need an angle grinder to take it off. I tried using a bolt cutter on a clamp before but it didnt work.

    This is confusing? Are they legal or illegal? I always thought only government bodies could issue a fine????if they're illegal why how do they operate here? Do they pay tax?

    Not too sure about them paying tax etc, the rest is a legal loophole which they've never taken anyone to court for removing one of their clamps

    I'd imagine the reason they are able to operate is because no one has bought them to court.

    If your going to pay was given good advise on similar post,,,, fill lock tumbler with super glue (or get a mate to do it unobserved) & at least some satisfaction gained....

    Cut the lock off the clamp, get a new lock and clamp the clampers van. Keep video/ a witness when they cut it off and take them to court for criminal damage :pac:

    Where exactly were you parked? Im confused as to how you can be half on private property and half on a public road? Are you sure that you have not been clamped on behalf of the council?

    There are parking bays at the side of a public road/cut into the footpath

    The bays are private and covered by by NCPS. The road is public.

    My driver's side wheels are a couple of inches outside the bay on the public road so NCPS have attached their clamp to a wheel on a public road

    Bit confused here but your car is in a private space so would I be right in saying you took someone's private parking space for their Apartment or business.

    You are in the wrong and count yourself lucky your car wasn't removed.

    I understand some of these companies do mad things but you did obviously park wrong as you stated yourself.

    remove the clamp yourself....but i would try not to damage it while you are doing it. They may be able to do you for criminal damage if you do. Most the time they just wrap the cahin around the wishbone...you may be able to drop the back wishbone bush/mount and get the chain off that way
