Questions about Solicitors actions

    We have had a solicitor working with us for 8 years on a family matter (to do with a will), having finally got a result before Xmas we received confirmation and cheques to bring an end to it all with the trustee company (they had to decide how to pay out as the will was deemed not sufficient under succession law). The day we went to collect the cheque we were told they had been cancelled as the Trustees said they hadn't a grant of probate on file so we had to wait for this.

    Out of the blue today 'our' solicitor informed us the trustees had changed there stance and the other parties would receive all monies, we got a one liner email about this.

    We phoned the solicitor and he said he doesn't know why the change and that all legal avenues where closed, he then said he had also been representing the other party in the matter, he has said he is now finished with the case and will not do anymore for us and he isn't looking for a fee.

    I smell a Rat and asked him for our file in full and all emails with the trust company and he refuses. Can he

    * Refuse to give us the file
    * Represent both parties in this dispute
    * Is he required to obtain some form of explanation how we can go from having cheques to now zero
    *. Just decide to drop us. We paid him the only time he requested money a year and a half back

    The information does not make clear what has gone on. If there is a lot involved financially you need the services of a new solicitor.

    Sorry I was trying not to overload, there was a lot of money involved +€50k. Is he allowed to represent us and the other party who was seeking consideration from the will? I think his involvement with both he has looked for the quickest way out at our expense

    NUTLEY BOY is spot on. It's not clear what went on and you need a new solicitor to take up the file and examine it.
