Wedding videographer

    Hope this is in the right section.

    Looking for advice on what we can do. Received our wedding video last weekend after waiting 20 months for it! We paid €2675 for their service and tbh while the visual quality is good the content isn't there.

    They where at both our houses from 8am and have only 2mins of footage. Does not show anything, definitely not "our story".

    The sound quality is beyond poor, considering their price. We viewed lots of samples of their work and was nothing like we ended up.

    We are both very upset and angry. We told him this and asked for changes - to which he just cut content from our already short film and added in new content. Which made us even more angry - why wouldn't that be in the film in the first place.

    Obviously dealing with this guy has been an ordeal, 20 months after wedding only seeing final film! It's not fair on us and what we paid and to others who might book him to go through the same.

    He is based in Northern Ireland, any advice for pursuing legal action??

    Here are a few suggestions.

    Some relevant legislation.
    39.—Subject to section 40, in every contract for the supply of a service where the supplier is acting in the course of a business, the following terms are implied—
    (a) that the supplier has the necessary skill to render the service,
    (b) that he will supply the service with due skill, care and diligence,

    (c) that, where materials are used, they will be sound and reasonably fit for the purpose for which they are required, and
    (d) that, where goods are supplied under the contract, they will be of merchantable quality within the meaning of section 14 (3) of the Act of 1893 (inserted by section 10 of this Act).

    The photographer is based in the North. We don't know exactly where the contract was formed but look at this, as regards jurisdiction of the Irish courts.
    Article 5
    A person domiciled in a Member State may, in another Member State, be sued:
    1. (a) in matters relating to a contract, in the courts for the place of performance of the obligation in question;
    (b) for the purpose of this provision and unless otherwise agreed, the place of performance of the obligation in question shall be:
    - in the case of the sale of goods, the place in a Member State where, under the contract, the goods were delivered or should have been delivered,
    - in the case of the provision of services, the place in a Member State where, under the contract, the services were provided or should have been provided,

    Considering the relatively small amount of money involved, you could consider approaching this in two ways:

    1. Go to your local District Court and speak to the Small Claims Registrar about a using the small claims procedure, but be aware that the maximum amount that can be claimed is €2,000. If you deal with the matter yourself, through the small claims court, the idea is that you won't have to go to the expense of engaging a solicitor.

    2. Go to a solicitor and either get advice on the small claims procedure or ask about bringing proceedings in the District Court.
