Liquidation of a club - theft

    Hi all.

    Where a club is being liquidated because it's not viable anymore, and a member takes property belonging to the club what recourse is there? It's not very valuable stuff, a few hundred euros worth maybe.

    Another member bought gear for the club (along with someone else) on the agreement they would both be repaid by the club asap for the gear.
    This member is now refusing to accept the payment (again low value) and is instead saying he is going to sell the gear himself and keep the money (possibly more than what he paid).

    Any options available to the club here?

    Well I assume this is all hypothetical. I would have thought if the property was taken dishonestly the recourse would be the gardai.

    If the club is under liquidation does it mater how the someone takes payment?

    Do clubs follow the same sort of rules as companies in formation? Was this one formed officially? I thought, and am happy to be corrected, that clubs were just clubs by virtue of their members.
