Dispute between tenants :(

    Hey Guys,

    Im a college student struggling to survive and up until recently I was sharing a house with 4 people. We all signed the same lease and it was made clear to us that we were joint and severally liable for the rent. 2 of them have now decided to break the lease and move out, and now my rent is going to double! Am I correct in thinking they are liable to me under contract for their rent if I have to pay it until we find new tenants??

    Can't give legal advice but assuming they are (and I genuinely don't know!) what is the likelihood they will pay. I'd threaten to move out also and make the liable to the LL and explain you're co-operate fully with the LL in supplying him with their addresses etc for the remainder of eternity.

    Joint and several liability is in favour of the landlord and doesn't necessarily create that relationship between the tenants. Each is generally liable for the full rent - you should speak to the landlord to protect your position. If they're doing a midnight flit, give him/her an opportunity to sort it out in advance.

    Yes, you can seek a contribution from your fellow tenants (unless there is some agreeement between you that you haven't mentioned). Whether you'll succeed in getting money out of them is another matter.

    Seek the landlord's permission to replace them.
