I was in a car accident yesterday, an elderly lady ran into de side of my car, we didnt call de guards cos we were both (thankfully) ok, she agreed it was her fault & she will pay for my car, but she doesnt want to go thru her insurance company, i didnt think my car was so bad just a small scratch & door bent in a bit, went to garage 2day, told i need a new door & wing, shud i report it 2 guards r is it 2 late, also shud i insist on goin thru insurance company, we didnt swap insurance details just name, address & fone no, she seemed genuine but im afraid when i tell her the damage 2 my car may cost a lot more than we thought she mite refuse to pay, any advice legally where i stand wud be appreciated!

Generally speaking, you should notify YOUR insurer and tell them what happened and notify her Insurer and tell them what happened.

Before calling her Insurer however, i would extend the courtesy of telling her how much the repairs will cost and if she is not willing to pay for them herself then proceed to claim from her Insurer directly.
