Road Traffic Regulations

    I have a query about the context of offences which are made by way of regulations, under the road traffic acts, such as those provided by s.11 of the 1961 act.

    does a person still "commit an offence under the road traffic acts 1961-2010", if the offence alleged is one which is prescribed by regulations made under those acts?

    for example, where it alleged to a person that they have committed an offence, by contravening a regulation made under those acts, can the following still be invoked; s.9(1)(a) rta 2010, or s.107(1) (as substituted by s.79 rta 2010) rta 1961 etc.?

    Many of the regulations refer to more general offences under the road traffic acts, in relation to which the minister is empowered to make regulations.

    Breach of those regulations would constitute an offence under the road traffic acts.

    It would be better if you referred to specific regulations, so you could get a more specific answer.
