    Interesting. From the ruling (http://www.ca1.uscourts.gov/pdf.opinions/11-1760P-01A.pdf) :

    "Elements of originality in a photograph may include posing the subjects, lighting, angle, selection of film and camera, evoking the desired expression, and almost any other variant involved.".

    So by that logic, all else being equal, an EXIF showing that a camera operator used fully auto would mean their image is less protected than a photographer's shot of the same scene using fully manual settings...
