Fixed Term Contracts - Warning

    This is a warning to those on continuous fixed term contracts. GET LEGAL ADVICE BEFORE YOU SIGN ANYTHING. More schools are putting in waiver clauses in contracts that basically sign away your employment rights. Once your contract expires and if you feel hard done by and feel you could challenge an aspect of a schools decision then you WONT BE ABLE to if A WAIVER CLAUSE exists in your contract stating that you may not use the UNFAIR DISMISSAL ACT. I lost my job because of this. I had three continuous contracts and this waiver existed in all three. I felt i was unfairly dismissed but COULDN'T take a case against the school BECAUSE OF THIS WAIVER.

    BE VERY CAREFUL THOSE ON 1st, 2nd and 3rd Year CONTRACTS.

    The unfair dismissal act may not be used on expiry of term of contract. You can't use it for fight a dismissal once your contract ends. It is wordy but that is the essence. i am in the middle of a case with a school and i signed 3 consecutive contracts with this in it. That is not my worry now. I also have a case of penalisation which i am pretty confident about.

    This is how things are done in the 21st century. It can be used for evil, but on the bright side it will make it easier to get rid of non performing teachers.

    If an employee whose employment started after 14 July 2003 has been employed on 2 or more continuous fixed-term contracts, the total duration of those contracts may not exceed 4 years.
    After this, if the employer wishes to renew the employee’s contract, it must be an open-ended contract unless there are objective grounds justifying the renewal of the contract for a fixed term only.
