Temporary layoff

    I have been on temporary layoff since end of oct and its clear there is no work available. My boss wants me to fill in the rp9 form to claim my redundancy and save on the one months notice I would be due.
    My question is at what stage should he be making ME redundant. This would then entitle me to my notice. Is 12 weeks a reasonable time to be on temporary layoff.
    Just to note I have worked there for 5 years but the relationship has broken down as I haven't been paid what I'm due. I've also opened a case with the rights commissioner.
