Separate title deed for garage

    Hi - I'm interested in peoples thoughts on the following:

    I'm considering buying a terraced house which has a complication associated with the rear garage. The complication is that the seller has created a separate title deed for the garage down the back for which he has rear access and is not prepared to sell at the moment (He's using it to store two classic cars).

    He has no door from the garage to the back garden so the garden backs on to the wall of back of the garage therefore leaving no rear access to the garden.

    The seller has apparently included in the deeds for the garage that should he decide to sell, the new owners get first refusal.

    I'm not that concerned with the garage issue as long it's not sold on as a band practice venue or something crazy.

    What I would like to do is build a workshop/shed at the back of the garden which would back on to the garage.

    I'm wondering if my shed would be considered exempt from planning (providing it's within the area guidelines for a shed etc.) or would the existing garage (even though it's a separate title deed) be considered to be taking up some of that allocated 25 square meters?

    Apologies in advance for the wordy post - hope I've explained it clearly enough.

    An interesting query and one that could possibly generate different responses not only here but from different planning authorities. A couple of questions though:

    Was planning permission granted for the garage?

    Was the house subject to planning?

    I'm only in the early stages of evaluating the house so I've not had a chance to probe into it too much yet. I think the garage is under 25 square meters and about 2 m high so it might not have needed planning as the remaining garden size is around 100 square meters.

    The house is part of terraced row in an established (30-40 years) Dublin suburb. I'm not sure if this gives any insight as to whether it would be subject to planning or not - i'll check on the next visit.
