Prenup agreement

    I want to get a prenup agreement...Anyone know any lawyer in Dublin who specialises in this area?Is it expensive to get one? Do I have to get it signed a certain period of time before the wedding? ANy advice hugely appreciated.....

    AFAIK these haven't been tested in the irish courts yet.... so value unclear.

    As far as I am aware the Irish Courts do not recognise prenup agreements. there was talk of a new Family Law Bill to change this a few years back but I dont believe (open to correction) that it ever came into being. this is of course in case it was to go to court.

    I am sure that any solicitor could draft an agreeement do do this for you but I would check the legal status issue asit may not be worth the hasstle if its uninforceable

    Well, even if unenforceable, it would still be evidence of an agreed position before the marriage and of who is bringing what into the marriage.

    Just see your local solicitor no need for anything specialist. Court will set it aside if they feel it's right to do so however.

    Prenup agreements are unenforceable in Ireland as they are considered "Contracts which subvert marriage." Marriage is constitutionally protected hence the courts won't recognize a prenup.

    The ultimate effect is that if a divorce is contested the Prenup is worthless.

    On a related topic, parties may enter an agreement prior to marriage to renounce their rights under the Succession Act.
