Reversed into at petrol station today- how long do they keep CCTV?

    I was hit into while parked at a pump at a petrol station today. My other half had gone inside to pay for the petrol when a driver parked in front of the shop reversed into me, causing significant damage to my bodywork.

    I'm just wondering, if worst case scenario she lies and says that I was moving forward as she was reversing (i.e. I'm partly culpable) and I have to ask the insurance company to check CCTV from the petrol station- how long is CCTV footage retained for, does anyone know?

    I would imagine at least 24 hours, but go back to the station and get a copy of the cctv right now. You never no if she knows someone there who could delete it, or if the recording only last a few hours.

    Differs from place to place, I'd imagine. I'd get on the phone to them now and ask them to hold it. They won't give it to you, but if you inform guards as part of a claim, they'll be required to hand it to them.

    you legally entitled to a copy of any CCTV which your filmed in as part of the data protection act.you need to pay a fee though.
    Access Requests

    Any person whose image has been recorded has a right to be given a copy of the information recorded. To exercise that right, a person must make an application in writing. A data controller may charge up to €6.35 for responding to such a request and must respond within 40 days.

    Practically, a person should provide necessary information to a data controller, such as the date, time and location of the recording. If the image is of such poor quality as not to clearly identify an individual, that image may not be considered to be personal data.

    In giving a person a copy of his/her data, the data controller may provide a still/series of still pictures, a tape or a disk with relevant images. However, other people's images should be obscured before the data are released.

    I am pretty certain cctv is kept longer than 24 hours , id say a month.

    It all depends how many cameras, quality and dvr unit.

    Give the garage a call or call down and just ask would it be possible for them to save the pictures at the time it happened.

    You will have to request under freedom of information act.
    The Gardai can get a copy but don't think they will get involved in that.
    Let your insurance know asap and tell them you have asked for a copy of cctv footage to be kept.

    Have you reported this to the Gards as yet? (it'll be easier to get hold of the footage if they know) And did you exchange details with the other driver. You'll also need call your insurance in the morning.

    As soon as I got out of the car I took photographs of the damage, the other car, and the insurance disc. I will be on the phone to insurance first thing in the morning. I haven't yet got the Guards involved because I've been told that unless someone has been injured, they're reluctant to get involved. However, if the cogs of justice aren't seen to be in motion by tomorrow, I shall be calling on them.

    Interesting. Naturally, in the prevention of breaching the DPA one would also be required to remove any other people and or vehicles and their corresponding reg plates from the relevant footage?

    Yup, totally agree. Similar thing happened to my BiL. Fella got in first and told a whole heap of lies to the insurance. Wasn't able to get hold of the CCTV footage either as the whole thing was wiped a day later.

    Most insurers have a 24hr claim line. Call them NOW. I'd also write a statement detailing what happened, when, where, time, description of driver, and any other details you can remember. Make a sketch. It'll come in handy later.

    Thanks for the replies. I rang the station looking for the CCTV and was told I would have to report it through the Guards, but it seemed straightforward enough. I believe they keep the CCTV footage for one month before it's recycled.

    In the event, the other driver admitted responsibility so I didn't have to go through the process of obtaining CCTV.
