No rent book/receipt landlord saying arrears now owed

    Hi family member has got themselves into a bit of a sticky situation. They've rented the same place for the last 10years and over that time have been (to best of my knowledge) decent tenants, rent late a couple of times after a car accident and once when son was in hospital but always made up the rent the next month. Doing (with his permission) and paying for repairs themselves. In 10yrs only thing he's had to do is replace the fridge that packed up.

    Now they are saying the landlord is saying they owe him nearly €600 for rent that they've missed or paid short. They have no rentbook or reciepts to prove they've paid anything he's paid cash every month, sometimes he collects and sometimes they've posted it through his door. I told them to tell him to go and jump but they are reluctant to do this in case he throws them out. Can he do this or will he need to prove they've not paid him?

    They should be registered, but by your description it sounds like they are, and he is not registered meaning he possibly doesnt declare this income to the revenue.


    Call the PRTB or threshold for advice (start with threshold)

    Let him take a case with the PRTB if he feels that he has sufficient evidence to back up his claim. Chances are he wont bother unless he really does have a legitimate complaint, in which case they will have to pay him back either way.

    They are insistant he's wrong to the point where he even phoned them once because they'd miscounted and he was €5 short and the next month they gave it him back.

    I'll tell them to call threshold.

    I had a sloppy, heavy drinking landlord a while back. No receipts after 3rd month.

    So I got a receipt book and used to get him to sign it and I'd GIVE HIM a receipt.

    When the time came to leave, this man had been borrowing money (rent) for clutches mid-month and for oil burner secondhand parts (nightmare) and so I told him we'd be using the deposit as the last month; which wouldn't be an issue as he'd viewed the place too many times (kept collecting his post without any notice) so he knew it was twice as good as he'd left it to me. I was a greenhorn moving in; he was a greenhorn LL by the time I was moving out. As I had the power of BOARDS behind me :-D

    Not a happy camper, so he wasn't; not the legit thing to do. But the sensible thing to do when dealing with Bollicky Bills. Sins of omission are just as burdensome as sins of commission.

    Your relations should have a rent book and get a monthly signature. Putting money in through a door?? Ah come on now....? Cop on. We all need to audit our lives and our finances. Boards is the best place for soundings. Or if you like Bollicky Bill advice, there's Ars*d About Brendan, sorry Money.
