    Advice needed,Can council board up my home, throw my guests out with the help of a lot of guards!


    I returned to find my home turned upside down by the Gardi and council with no warrant,my home was partly boarded up. Locks removed. My child's toys my clothes all our belongings throwing all over my home'
    I'm so upset, I was giving a month to leave my home, if I didn't legal proceedings would be held against me. I was served this last month when I got home a lady handed me a letter for further evicting if I didn't leave premises. None of this has gone to court yet? Was that the legal proceedings to come home and find that, as only as an Irish citizen I taught I was to be taken to court, got handed this letter, she told the lads to remove all stuff off the house, but is this right as I'm lost and very upset as to what to do, I was told by my local guard that they didn't need a warrant to enter my home, I'm now only finishing the damage down to my home, completely horrified as iv never been in trouble with the law before, please note this is on going reports been sent in from neighbours who claim my daughter and I don't reside, rent paid in full each week, admittedly miss a couple over the Christmas but nothing to have deserve this surely ???

    To be honest I dont really know what advice you are looking for here ?
    You were given a month to leave and you did not comply.
    You also did not pay the rent during the eviction notice term.

    I suspect there is more to this than you are admitting. Councils dont just go around throwing families out on the street. You must have had plenty of time to negotiate with the council or to make alternative arrangements.

    I only missed two weeks, I had a month for them to take legal proceedings, I wasn't home my guest was she was asked to leave, which then they intended to destroy my home, I was then served another notice for one months time, again saying take will take it to a judge, legal proceedings yes!! Surely iv some rights for them to enter, without warrant then to board up my home, had I not been on my way home I would never got in to my home, so my basic point before taking legal proceedings can they do this?

    Go to a solicitor, if you cannot afford one or can not find one willing to do it pro bono, then call in to both of the following The Legal Aid Board and FLAC (free legal advice centre).
