Owner occupied?

    Hey I posted here before about working in a voluntary capacity with victims of abuse. Again I'm not blowing my own horn (wish I could) just highlighting the vunerability of those involved. Anyway one of the teenagers has started to rent a room in the house. Everything was going grand until two things happened. The house was advertised as not owner occupied and when the chap in question turned up to view the house and room the owner didnt mention it was owner occupied.

    Anyway turns out the owner does live there and sleeps in one of the common rooms. He isnt an unpleasent man by all accounts but he has also forbid the teenager to recieve mail to the house (he doesnt declare tax) and he told the chap that the house is owner occupied (him) and the chap has very little rights as regards eviction.

    Now the renter signed nothing at all saying it was owner occupied ect. What are his rights here? If he is mistreated I would have no problem going to the tax office or getting other heavies involved but I dont want to do that yet. This chap comes from an extremely vunerable background and I wont let him be mistreated. Has anyone come across this situation before?

    The owner-occupier, is entitled to receive up to 10k rent from renting out rooms in his principle private residence, tax free per year. He or she does not have to register the tenancy (as they are living there under licence, and are not legally tenants), they do however have to declare the income to the Revenue Commissioners.

    If the teenager wants to live in a non-owner occupied property- unfortunately he or she will have to move. Term of notice for moving will be as per whatever was agreed when they moved in.

    The owner was an idiot for advertising it as non-owner occupied, however that appears to be the worst they've done. God only knows why they don't want post delivered to the house. Perhaps they don't know about the rent-a-room scheme?

    If he has kept a copy of the original ad where it states the accommodation is not owner occupied, he could possibly negotiate to move out retaining his deposit as it was misleadingly advertised.

    Like the poster above said, he probably has no tax liability; not sure who the other heavies are that you refer to?

    Just to be pedantic. Hes entitled to recieve up to 10k income from renting out rooms that income includes money for utility bills etc not just from rent not that many even get close to that figure

    He lives in a big house and is renting 6 rooms in total. Each room varies from 350-400. He told the people in the house he's not letting mail come to the house in case he's caught and liable for more tax. He also advertised all the roomsunder the disclaimer owner not occupied. Yes we have a copy of the original ad also.

    doesnt sound like this would be a tennancy id want any part of. I think your friend needs to look at giving notice and finiding somewhere else.

    id also shop the landlord to revenue.

    Well I dont want to come across as an a§₩hole by bringing up the mans taxs. It's just in case he tries anything with deposits.

    Six rooms at 350 a month is well over Revenue limits for the rent a room scheme (if he even qualifies given that he's sleeping in a common area). If he's not paying tax he is taking money out of everyone's pocket. I can appreciate that you're looking out for a vunerable youngster, but surely once he's out of this house you'll report the landlord?

    If he f**ks around with the deposit, ask him for his PPS number, as you need it for the Revenue. Say you won't report him to the Revenue if he gives back the full deposit.

    Wait two weeks after the kid moves out, and report the landlord anyway :P

    your not, hes the a§₩hole that's defrauding this country and costing me and you more money.

    He should be ratted out end of. Roughly speaking hes costing the taxpayer about 14 grand a year in tax hes not paying (going by the rental amounts you are suggesting). Why would you feel bad when hes screwing us all for that amount of money. Would you have as much sympathy for a thug that robs 14 grand from a post office at gun point ?

    I would like to thank everyone for thier humanity regarding this thread. You should all be proud of yourselves and I cannot express enough thanks for eveyones help. I'm sorry to say but the young lad attempted suicide and we have found emergency accomodation for him and I feel responsible. Thanks again everyone I acted on the points before he tried suicide and because of that he survies. I'm sorry If Im embarrassing anyone posting here but I need to get it off my chest.
