Company Cannot Pay me Redundancy

    ok well i'm being let go this friday after 12 years of service ( and im so glad )

    but my company are so bad financially that they cannot pay me my statutory redundancy , so i have to request it from the Social Fund

    what do i need to get the wheels in motion , and what does he need to provide me with ???

    I'm lucky that im walking into a better job with better money and prospects , plus i have to get my 22 days holidays im owed so thats just over 4 weeks pay.

    i just don't want friday to come and realise i need this letter or that and then it drags on , once i get all documents and when i walk out thats it , end of this chapter and on with a new one , so i dont want any reason to have to come back in here

    Make sure that your claim is filed on line. The company i worked for went into liquidation last summer. Staff recieved their redundancy payments from the within within 6-8 weeks of the claims been submitted online.

    I just hope you're not expecting a quick payout - a mate waited the guts of a year. Very odd for a company currently trading to so this AFAIK.
    Not at all odd for a company still trading to to this, A company I previously worked for let about 20 people go over a period of 1-2 years, and all had to claim from the social fund, I think I got mine after about 2 months waiting, go to citizens advice, they'll tell you what forms you need.

    2 months for my redundancy from social fund to come in, not to bad, but im still waiting for back pay and notice pay.

    ok so i finished up on the 25th

    i'm still due about €2450 in holiday pay

    what are my rights on this ??

    the company is still trading but to be honest don't have a pot to piss in , do i go legal after a certain amount of time ??

    i got the accountants letter stating they can't pay my redundancy so ive sent off all documentation regarding redundancy from social fund

    but my holiday pay is my immediate issue , how do get my money

    i know a hell of alot of stuff on these guys and they companys they deal with , if i dont get my money i will squel like super rat , as to me its personal if they try shaft me so to speak

    1 having an affair im sure his wife would like to know , they are owed over €500k from other company , id call them companys and tell them not to pay as these are fooking sub-contractors all the time , pure cowboys

    Best place to get the info you need is citizens advise they are very good. Blakackmail is not a good idea as its illegal but do what you feel you need to. You are not the only disgruntled employee of <snip> they seem to run a bad ship from what I hear.

    Chill out and be professional. You do any of that and expect your ass to be sued all over the shop for blackmail, slander and more. This could easily bring a severe financial penalty or jail if serious so calm down. It's hardly them being personal if you admit they haven't a pot to pi$$ in and that means they may not have the money to pay. You can take them to court to try recover the money owing.

    was in the same boat last year the company will give u a copy of everything but the company has to file for it for u i was told i'd be a year or more waiting for it but had it in 6 weeks it just depends how busy they are they do it month by month hope this is some help

    Thats a last resort what i would do

    Dont have a pot to piss in but still get money from somewhere to pay sub contractors and wages

    Even as a last resort you will get youself into a legal bind which is hard to get out of and the courts would have a dim view of your actions and could easily bring a severe fine and jail term for you.

    You have the option of making a complaint to the employment appeals tribunal.

    actually come to think of it

    13 years service what notice do they have to give me ??

    i knew i was finishing up but not what date , we talked about it loosely at xmas but never stated you will finish on this date etc

    told me 1 week in advance and then there was a problem getting paperwork from accountants for redundancy so then said leave it till nect week

    no writen confirmation etc

    Whats your notice period?
    You should get that much notice, if its a week then all is well, if its not then they owe you the difference.
