Retrospective charge traffic offences?

    Can the Gardai retrospectively charge anyone for traffic offences (for example having no roadworthyness certificate on a school bus for months) if the person has disposed of the vehicle, or does the person still have to be in ownership of the vehicle?

    My sisters children were being brought to school for months on abus which had no certificate, but now they have sold on the bus.

    The fact that they have sold the bus doesn't get them off the hook but the Gardai might find it more difficult to convict them. I don't know the ins and outs of the offence you're describing (in terms of what proof is required in court) but the answer to your question is that in principle getting rid of a vehicle doesn't mean that you can't be convicted of an offence committed with that vehicle in the past - subject to the six months rule for commencing proceedings as with all summary offences.
