Tax disc OoD = ticket?

    Sorry if this has come up before but im looking for some advice about this, was parked on the south mall today and got a ticket stating I failed to display a current tax disc, tax disc was out of date but I had paid online the night before for my tax. Have I any grounds to appeal, if I don't I don't want to be paying more than I should . Thanks

    You can appeal once you get the disk

    No. The offence is failing to have a valid disc on display.

    Any of the lads in here who have appealed even if they just paid the arrears have gotten away with it.

    what if I appeal showing the receipt of the taxdisc, I feel the longer I wait the more dodgy it looks

    I've never done it so I don't know for sure but I can't imagine the receipt being a problem.

    I would appeal and show them the receipt proving you had taxed the car but are waiting for the disc. Once they get that (and check with Shannon), I would imagine you'd be OK.

    There's no set rule that you can appeal it - non-display is non-display. But in the spirit of the law I've heard of many many instances of a case being thrown out or a FPN quashed if the person shows that they have paid their tax or even paid it after the FPN was issued.

    I've appealed it in cork - got a ticket on a car the day after I bought it, once I had it in my name and taxed I called into the office on anglesea street and got it sorted. I don't think it was done there and then, it had to go for consideration and I got a letter afterwards to say fine was waived or whatever.

    You know the traffic wardens office is just off South Mall, or it was when I lived in Cork last? You'd want your discs in order there of all places!

    In your case the tax was simply expired so it may not work out for you. Worth a shot though.

    rang the office today and was told to appeal it on the grounds I was waiting for it in the post, she also said that if I send it in with the 14 day appeal period and lose the appeal I can still pay the original ticket fine if I do so within 6 days of the appeal, so might be worth a try.

    Appealing to a council is for mugs. They will not accept your reasons.

    I would let it go to court and land them with costs when you win.

    If you bring it to court why would you win?

    You would be summonsed for non display of a current tax disc.. The fact you had paid for the tax disc a day before, or 2 months before still doesn't negate that fact. This offense is different from not having a current tax disc.

    Now a judge might use discretion but to the letter of the law you would be guilty of the offense.


    And I didn't think you could claim for expenses if you did win in the district court?
