bonus and leaving job

    my brother is thinking of moving on from his current company, and giving a months notice which would give him a leaving date of ~early-mid february.

    Bonus at the company for 2012 employees will be paid in March.

    he has worked there since 2010.

    Is he entitled to anything?

    Once his performance rating was complete for 2012, the bonus I imagine is dependent upon that. So I'd imagine he is.

    I've seen this in the past many times. Even if he left mid way through last year, he would be entitled to have his bonus pro rated and sent to him next March. Every company is different though.

    He needs to check his contract, some companies will put in clauses that bonuses will only be paid if the employee is still with the company on the date the bonus is paid.

    This. There's not necessarily any bonus "entitlement". Some companies operate on a 13th month principle where the bonus forms part of the core salary and so is payable pro-rated when the employee leaves.

    Other companies operate it as an actual salary bonus which is only payable if the employee is with the company when the bonus is paid, regardless of whether they've completed any kind of review process.

    Whether your brother is entitled to all or part of his bonus will be dependent on what his contracts says.

    my place, bonus is only payable if you're not serving your notice

    In my place you only get the bonus if you are working here when it is being paid out. If you leave during the year you lose the right to it. Check the contract or is he in touch with anyone who has left the company, he could ask them?

    I doubt it. In the last place I worked there was a girl who handed in her notice just before the bonus was given out. She was naive in thinking it wouldn't matter as she felt she was entitled to a bonus and was being honest but she wasn't given a cent.

    This is also the case in my work.

    If I was your brother I would hang on in the job until I see the money landed into my account then start the notice period.

    Surely not that difficult to hang on an extra month or 6 weeks for the sake of a few grand.


    I was just talking about this exact situation with a guy I work with. He's leaving 4 weeks. Our bonuses get paid out 5 weeks. I thought it was insane to not hang on the extra week. Now he's missing out on on a 20-25% bonus

    misuse of the word 'entitled' here. There is no provision in law which entitles a worker to a bonus. Any entitlement will be entirely dependent upon his contract. Many don't pay a bonus if you leave, some will pay pro-rata.
