Car I Traded In Gone Through E-Flow?

    Hi Guys,
    Just a quick question, I traded my car into a garage in early August and since then I have gotten about ten E-Flow statements in the door. When I went down to the dealer, he said that it must have been on test drives and that it would be sorted. It turned out that the car was still in my name and the toll remained unpaid :mad:. Now the dodgy dealer has shut up shop and E-Flow have told me that because the car was in my name and I was liable even though I have the receipt. The car has been sold since but I got a letter from their solicitors today stating that I owe €145 per transaction and will be summonsed to court if it remained unpaid.
    What do I do? as the dealer has gone bye bye. Will it stand in court?:confused:

    I'd guess if you can prove you sold it with the receipt then it should be easy enough to contest.

    Solicitor probably your best bet.

    Why was the car still in your name. Did you not send off the change of ownership form when you traded in the car?

    No as the car was a trade in to a garage, I didn't feel the need to. I regret that now....

    fax them the reciept, tell them if you get further correspondence you wil be passing it to your solicitor. thank your lucky stars it was not parking fines, speeding etc.

    I told them that I was going to do that, but they said because it was not a legally binding document that it would make no difference?

    Trading in a car the dealer just holds onto the logbook afaik

    Just to play devil's advocate here....they kinda have a point.

    Gimme the name of a dealer and registration number and model and i'll post a receipt for sale here in an hour or so. Complete with company logo and stamp...

    Going to be hard to prove it wasn't you or that you no longer owned the car.
    I don't suppose you took any holidays during that period of time? Flight tickets to prove you weren't in the country?

    Maybe some paperwork from the insurance company to indicate change of car?

    None of these individually would really 'prove' anything but they'll all add up to your case?

    Good luck with this.

    As an afterthought, anybody know how good the Eflow pictures are? An old friend of mine got out of a speeding fine in Holland by showing his flight tickets proving he wasn't in the country in combination with the picture from the original violation clearly proving it wasn't him driving. Might be worth asking eflow for the pictures, times etc.

    This is what usually happens in my experience, what SHOULD happen is :

    If you sell your vehicle to a motor dealer, you have to complete a Form RF105 (pdf) (Notes), which is available from the motor dealer. The completed form should be returned to the Driver and Vehicle Computer Services Division, while the Vehicle Licensing Certificate and Vehicle Registration Certificates (Vehicle Registration Certificate for post-April 2004 vehicles) are given to the motor dealer.

    From what I remember this shouldn't result in an additional owner listed on the logbook (maybe someone can correct me) which is the excuse the dealers tend to give for not filling out the paperwork.

    Not much help to OP at this stage though

    Yes you do have a point,
    I have the paperwork from the insurance company stating the change of policy off that one to the one on the receipt alright hope that proves ok.

    Im sure you have adequate documentation to prove to a reasonable person that you were not the owner of the car at the time of the fines.
    You have insurance change over details on the day of the sale, receipt of purchase & trade in from garage.

    no it wont stand in court but if you go to peace comissioner swear on the bible will b sorted

    I was in the same boat a few years ago. I called Shannon and they sent me out a form to get signed in the local Garda Station and I then sent it off to Shannon. They in turn sent me another form back and I sent it to Eflow. All outstanding fees were quashed.

    I did the same and I also sent them on a copy of the receipt I had from the garage aswell and that was the end of the matter

    Hi All,

    I would like to echo Moanin's advice.

    If you contact the Dept of Transport in Shannon, they can guide you through the change of ownership process. Once you are recorded on their system as the 'Last Valid Owner' with the date and time of sale, then all tolls after that date will be transferred to the new owner. eFlow gets all vehicle ownership details from the Dept. Transport.

    This is a common occurrence and eFlow has procedures in place to assist anyone caught in this unfortunate situation. So, if you have sold a vehicle and receive correspondence from eFlow, give us a call, contact us here on Boards or Tweet us. We will do our bit to help resolve the issue.

    Thanks for the replies, I have been on to Eflow's Solicitors and explained to them the situation who in turn have told me to contact the Dept. of Transport.
    Shannon are sending me out a form that is to be signed by a peace commissioner or solicitor and all will be resolved:).

    • Use registered post if you can - and don't delay
    • Record the date and time of sale on the documents
    • If you are trading in a car, get a copy of the documents for your own records. Record the date and time of the sale
    • If you receive correspondence from eFlow, call us as soon as possible to resolve

    Don't go looking for the garage owner who is only going to fob you off with promises to sort it. You need to be proactive and sort it yourself.

    Also always post off the transfer of ownership forms yourself. Never ever allow a dealer to do it.
