Road Traffic Act

    Hi,

    I would like to know if there is an Act stating condition when car A (on parking space) joining into estate road collide with car B.

    I was looking some acts but it's a vast source of information.

    I really appreciate any kind of help in that.

    Btw. I'm driver from B car.

    OP what exactly do you mean?

    Was car A turning from a parking space into a road that car b was on?

    Are you trying to figure out who is at fault?

    never mind the road traffic act, if the other guy caused the accident, he pays, if you did , you pay.

    OK, I will explain it to you.

    I was collecting wife and kids from apartment. I've parked in front of it, collected them and being on main road I've was reversing a little bit on that road aiming for parking spot to get into and drive off. After 2-3 meters I was stopped (collision) by other car also reversing but from parking space. It was a estate road so speed wasn't big. It's very unusual situation and it is the a reason why I'm asking.

    In my opinion it's her fault because she was joining into "traffic".

    I've received phone call from her insurance company and they told me it's 50/50 fault. I don't really agree with that.

    It's something totally new for me so I want to backup myself with all useful information.
    Road act could help me. On normal road when car joins traffic it's his fault but in my case it's not clear enough.

    So you were both reversing on the same road and hit each other?

    That to me sounds like 50/50

    Wait a minute, so both cars were reversing, and you both reversed into each other? 50/50, and pay more attention next time you're reversing.

    That way the insurance companies get to screw both drivers (excess, NCB, etc)

    Unless the cars are made of chocolate, I can't see any reason for getting it fixed through insurance.

    no no. There were a plenty parking spaces. I was reversing in straight line in time when she collided with me. I was aiming for different parking spot way behind her car.

    Paying attention it's different thing. When you are on main road it's obvious that other cars should pay extra attention before joining into traffic. I have same attention as driving normal way but less visibility.

    You were both reversing. Sorry, but you are both at fault.

    It doesn't matter if the other driver was in a space or not, nor does it matter that you were reversing from the road in to a space. You were both reversing, and neither of you were paying enough attention.

    did you hit each other in the parking space or on the road?

    If you hit her while she was in the space trying to manovoure out and you were manouvering into an adjacent space potentially you may be at fault for moving from the road into a space that she was occupying.

    If you hit her you weren's paying attention and neither was she.

    Unless the cars are made of chocolate, I can't see any reason for getting it fixed through insurance.

    It's not that easy here car was already after a lot of different crashes etc. My not. I have cracked bumper and rear lamp is gone, also some scratches on body. Used parts and work will cost me 300-400e. To paint it's 150e for on piece. It's not that cheap when you sum everything up.

    Any car reversing is require to give way to all other traffic. You were both reversing therefore both at fault for failing to give way. 50/50 blame.

    I think it's just one of those things where both drivers were caught out by an unusual situation. No matter how careful you are, something can always move into a blindspot when you're looking the other way in. All you can do is keep speed to an absolute minimum, meaning that at lease only a light was broken here.
