Hand notice but got a holiday planned?

    Hi all. as the title says i want to hand in my notice.

    the issue is that i booked a month off work between mid feb/march next month and got the holiday approved last year.

    i carried over 5 days from last year and i am usually entitled to 23 days per calendar year running from jan to december.

    i am on a 3month notice period and what i would like to do is hand in notice now and get for this month and next month/half of march for when i am on holiday.

    Now i have read that any holidays u do make that is over what you are allowed(average of 2 days per month) u have to pay that time back but the fact that my notice period is 3months, will they deduct the time i owe from my notice period so instead of having a 3 month notice, it works out as 3months minus 15 days of unallocated holidays i owe?

    i do not want to suggest or agree to do a 1month notice and go on holiday and come back broke and no money for anotehr month or so so would like to get paid for at least while im on holiday.

    i also do not want to hand in my notice AFTER i come back as that means waiting till June! to leave.

    You've carried over 5 days, and if you divide your annual entitlement of 23 by 4 (i.e. your 3 month notice period), you'll accumulate roughly 5.75 days by the time your notice period is finished.

    So depending on whether your holiday will cover any public holidays, you'll be using just over 9 days annual leave that you will owe them.

    I think what would happen is that your final pay check would be reduced by the 9 days or so, but I'm open to correction.

    What you're suggesting is that your notice period would be reduced AND you'd have taken extra leave that you have not accumulated, which doesn't sound right.

    It works like this:

    hand in your notice 8th Jan. You have a 3 mth notice period which means your last day of work should be the 8th April. Now, the notice period can be shortened, with approval of your employer to take into account any unused holidays. So you have 5 days carried over. By the day you finish you will also have accrued aprox 6.25 days leave (I am calculating this as 23 days per annum divided by 12 = 1.91 per month. Jan to March is 1.91 x 3 = 5.73. For April there are 22 working days, so 1.91 divided by 22 and miltiplied by 6 (OP will work 6 days of April) = 0.52) giving a total of 6.25 days). So the total leave you will have on your last day of employment is 11.25.

    So if you are given permission to use your leave against notice, this means you work until 14th March, do a few hours on the 15th and then finish up. You will get your full months wages.

    However, you want to take a month off mid feb to mid march. You don't have enough leave accrued for this, so you will only get paid for the leave you have accrued to that date and the rest will either be time of without pay, or you will get paid for your full month in Feb, but when you leave you will have the holidays you were paid for but had not yet accrued deducted from your final payslip.

    So in your situation, you might also find that you go off for a month in Feb/March and then have to come back and work until the 8th of April.

    Really, if you didn't want to have to work after your holiday you should have given your notice sooner.

    That said, given that you are planning to be off for a month anyway and it has been approved, if you worked for me I would just tell you to finish up on your last day before your holiday. And I wouldn't be inclined to give you a great reference. But your boss might be different. They might insist you complete your 3 mths notice and make you come back after your leave. There is no way to find out other than to ask.

    But to answer your main question - no you won't get a full months salary when you leave. Your company are not going to pay you for days you have not accrued simple as that. So if you still want to go on leave for a month, then you need to suck it up and accept that at least 2 weeks of this will be leave without pay and will be deducted from your final wages.

    True, but the would need to be giving OP notice to that effect fairly sharpish, as they need to give a months notice if they intend to cancel the holidays. Also, depending on the employees contract and work conditions, the company might have to compensate OP for any expenses incurred such as flights/accommodation etc.

    Cant cancel. i have already booked my flights and everything. this was approved and sorted like 2-3 months ago.

    the reason why i want to hand my notice now is because its 3 month notice and waiting till i come back means i have to stay here till june/july
