Section 47 advise needed

    We are looking at sites at the moment to build, the one we want has a section 47 agreement attached to the land as the owner sold 3 sites in 2004. The s. 47 is for 10 years so in 2014 it will be lifted. But i would like to start the process now, has anybody got any experience of Section 47's being lifted before the time is up? We would satisfy the local needs and we have been advised there shudnt be any other planning issues.

    Any advise would be appreciated

    I assume the S.47 agreement entered into is a sterilisation of the land/site from development for ten years?
    It is possible to apply for permission to remove it. Only the local Planning Authority can do this.
    If there are no other planning issues which would restrict/prevent planning then it is very possible that the PA will decide to remove it early. You can arrange a pre-planning meeting to discuss this.
