    Do you want an €1800 fine?

    If they enforced the rules like this with everyone the ole 3 months on 3 months off folks (who actually drive the car while it's declared off the road) might have to rethink their strategy.

    I just stuck that in to wind you up :D.

    To declare your car of the road during a period that you had been stopped for no tax, after the event and get away with it...

    She should have been discharged from what ever token 'job' she does without a pension not fined her weeks pocket money. I don't know what to think of that sort of elitist ruling from the judge. Seemed to support her idea that she was above the law.

    Tax was over three months out of date when she was spotted on the mobile.

    Ya and thats two fines and two points, how did she end up in court. was it because its the third time caught with tax out that she got summons.

    According to the article...........

    The court heard that Ms Healy Eames was first detected on March 10 using a mobile phone while driving her Mercedes in Oranmore, Co Galway. On that occasion, Garda Cafferkey did not stop Ms Healy Eames but issued a fix change penalty which was subsequently paid.

    When he checked her car tax on the Pulse system later that morning, he discovered it had expired on January 1, 2012, and a summons was issued on the matter.

    On June 23, Gda Cafferkey observed Ms Healy Eames driving in Seafield, Maree. When he later checked the car on Pulse, he discovered it was still untaxed. A second summons was issued.

    Garda Cafferkey gave evidence that on July 2, at Moneenageisha in Galway city, he witnessed Ms Healy Eames driving and checked the tax status of the car on the in-car system.

    On discovering that the car remained untaxed, he stopped the Senator and seized the car.


    Presumably after the car was seized a third summons was issued, I would imagine she had ignored the first two ??

    I would love to know what the annual rate on her car was, usual rubbish journalism points at it being "a Mercedes", my guess is it's a car with the 3.2 litre plus rate and the fine she got is less than a years rate on it. Standard fine should be the time it's out plus one years rax as the fine, regardless of make or model.

    The fines for no insurance are even worse, a young lad below 25 driving with no insurance will get at max a €500 fine which is hardly a fraction of the €2k plus they would be paying.

    A ban is not mandatory for a first no insurance offence.

    I'm open to correction on this, but if she was prosecuted for that, found guilty, it would be felonious - yes ?

    This being the case, would she be allowed in the Dáil, and have to resign her seat ? (dunno, just asking..)

    I don't recall ever claiming all cars on the road were taxed ;)

    Surley the first (and second) "summons" was for payment of fines and not a court date.
    As bad and all as it turned out, the first time offence (not taxing the car since Jan 1st) did not warrent a court date, at that time.
    There is also another question about when the transition from these summons turned into court appearances.
    June 23rd - he observed her driving with no tax again and July 2nd gave evidence.....
    So 9 days after the second offence, court?

    Edit: just re-read that "Garda Cafferkey gave evidence that on July 2....

    They do not have to issue fixed penalties. They are free to go straight to a summons if they feel like it.
