[A COMPANY] harassment

    Hi all,

    First and foremost apologies if this is the wrong place for this, however I felt this is the right crowd to ask.

    Over the last 3mths I've been getting texts from A COMPANY pressuring me to pay my bill. Sounds fair, except I am not an Airtricity customer. After the first few I contacted them by phone, and the staffer kept me on the phone over an hour while she tried to sort it out, eventually saying the tech department would have it erased.

    About a month later the texts started again, so I called again. I explained the whole thing over and that I had already been onto them about it with a promised resolution. The staffer this time said she had found the number immediately (instead of taking an hour) and said she would delete it from the system right away.

    All well and good until today, and the texts have started again. I feel this is absolutely ridiculous. I've been told twice that my number would no longer be in their system, and one of those times I was assured it wasn't accidentally put in by anyone else. Either the staff are blowing it over and lying, or they are incredibly incompetent at their jobs. Either way I have the same problem; constant harassment for money I don't owe by a company who aren't meant to have contact for me.

    I wuld like advice here about how I should handle this from here on out. Obviously simply ringing up is not going to resolve anything. Am I entitled to anything here? Does this actually classify as harassment or evasion of privacy (since they should not have access to my number)? Am I entitled to know any names or addresses that are attached to the number should any be found?

    Any advice on this would be most welcome, as I'm not entirely sure how to go about it.

    The Charter precludes the requesting and giving of legal advice.

    Practically: Make a complaint to the Data Protection Commissioners in writing. There are also angles from a Criminal Law pov which could be investigated, but I'd suggest you speak with a solicitor for that type of approach.
