Safe doesn't come into it when a passenger demands that the driver stop! he could have stopped even on a motorway in this obvious emergency!

He should have stopped on the street and let you out. by saying what he said it is quite clear he wanted and was intending to charge you the full soiling charge once he heard you were unwell. he refused to stop for you and has imprisoned you in his car and driven off with you, all witnessed by your friends!

Call a solicitor first thing on Monday morning.

You have to pay the fine as you soiled his taxi but he is guilty of a few offences. You can sue him for false imprisonment, he is also guilty of not stopping the taxi when instructed.

Maybe you should just pay the fine and try not to drink so much next time and you may remember more?

You cant say anything for sure because you can't remember. all your friends will have to make statements but if they cant remember either........Is this worth pursuing?

Why don't you remember? (lot of alcohol taken?)

How can you be certain it was safe at that moment to stop the car if you don't remember the night's events?

You might be the injured party here, but not being able to recall events is not going to help you.

Should he have stopped immediately if he was passing through the Red Cow interchange or up on a flyover of any of the other M50 interchanges or in the Port Tunnel?

First off, learn to type. It's not Bebo here :)

Secondly, I don't know anybody who would rather let somebody get sick in their car rather than pull over. Think about this for a minute. Get sick in his taxi at stupid O'Clock on the busiest time of the year, he has to spent time off road when he could be earning and then spending money cleaning up your mess. And you have very little memory of it all yet you really think he is up to some fast trick? Be honest here; do you think that is really happened?

Lastly, your actions last night are all that you should be complaining about here. You got over drunk, you caused hassle to a man doing his job and you need to realize that. When you go back to the driver tonight please have the good grace to apologize to him for the grief you have caused him, slip them the cash what you owe them and a little something for his troubles. Oh yeah, go easy on the sauce next time :)

unfortunately gunnygirl if you can't remember what happened i doubt you have a leg to stand on, even if your friends remember what happened its still your word against the taxi drivers once they got out of the car, let us know how you get on anyway.

I'm very highly educated. I know words, i have the best words, nobody has better words then me.

The smell of puke in a car would be enough to justify a cab driver wanting to charge, it would be the rest of his night screwed up as there is no way he could take on any more passengers in a vomit reeking car.

its not about the money.. Its about the charge and the way he drove off with me, wanted to know if i should complain...

where did he drive you to though? unless you actually remember yourself what happened after your friends got out of the car i'm not sure what you could do as it would be your word against the drivers word, you should complain absolutely but you may not get the result you want

All the more reason to let the girl out of the car when he was told she was going to be sick!

She only got sick in his car because he prevented her getting out of the car to get sick on the street, he brought it upon himself and should be charged with false imprisonment or worse. What kind of "man" drives off with young woman in his cab after her friends have got out? he could have assaulted her or worse.

So all her friends got out - but she couldn't even manage to get out herself, and apparently they weren't helping her out - because if they were, then he would not have been able to drive away without someone getting hurt.

What was he supposed to do - manhandle her out himself???

OP, you don't mention how you got home - I assume you spent the night in the cells? Hope you found it educational. IMHO you've received some very good advice in this thread re paying, apologizing and managing your alcohol consumption better - and it's been phrased a good deal more politely than I think you deserve. Apply it, and lose all thoughts of complaining.

d taxi driver was a prick... enough said and no act I went home!!! and i dont have a drinking problem.. I drank too much, which I never do so I just happened 2 get sick this one time and I was practically kidnapped by a v v stupid taxi driver! and i have complained him because of what he did. Doubt anyone would like to know that while there son or daughter had 1 too many 1 night were taken by a taxi driver against their will with the door open!! He did a foolish thing, I was drunk and sick so where or how could i possibly "escape" too? I admit responsibility for getting sick and having to pay, but it was the action of the taxi driver Thats disgraceful! So whoever has any more "wise words" about my "drinking problem" dont bother commenting because no one wants to hear it!! and thanks to the people who offered some sound advice! :-)

The boot sometimes goes on the other foot too. A cab driver I knew carried some passengers one night and failed to check the back of the car when their journey finished. Unbeknown to the driver one of the passengers had spilled a tub of curry sauce, from a carry out, on the back seat and the next passenger in, a lady who was wearing a brand new full length suede coat, sat right on it. Hell hath no fury like a lady's new suede coat dipped in curry sauce and the outcome was as follows.

The cab driver was given the option by the lady who owned this upmarket suede coat to collect the coat and get it cleaned professionally or she would be looking for a replacement or the full value, which would have been at least a few times the soiling charge as it was then. Luckily the driver managed to have it cleaned satisfactorily, but the episode had him worried for a few days.

I wold not want someone to be sick in my cab even if the charge was £1000, it is disgusting, the drive home usually involves being sick yourself and costs a fortune in lost earnings and cleaning.

One time I brought a woman home and she was sick in the back, it was not to bad, smelled of black current and foamy whatever the hell she drunk but was a small patch about cigarette box size. It was my last fair on a Sat night and I was off on the Sunday so I said if she gave me ten pounds to clean it or clean it her self we would be cool, she just flat out told me to **** off and got out of the car forgetting her nice coat out of next, I still remember the look on her face as I wiped the foamy blackcurrent mess with said coat.

If the driver had been civil and complied with his passengers instruction during the journey there would have been no sick in his car. The others only got out of the car because the lousy driver gave the girl no other option but be sick in his car. If it was me I'd have left him covered in it!

How can you believe anything she posts here? She said earlier in the thread that she was so drunk she didn't remember a thing about the night. Her mates were probably just as plastered. She never says what happened when she got to the garda station just that she didn't spend a night in the cells. I wonder was she even being taken to the gardai, sounds like she was so drunk the driver was taking her to hospital to have her stomach pumped!

I wouldn't believe a thing she posts to be honest.

If you have queries about your treatment by a taxi driver or the charges for the fare or soiling; don't rely on the advice of those in this forum (no offence to those that replied) as no one will be able to give you a 100% correct answer. Just ring the Taxi Regulator and ask them. They can tell you exactly what your liable for and what to expect from a taxi driver and they can investigate a problem with a driver too.

I would have treated her as a non-payer and gone down the correct route, by calling the guards. I would not have damaged her property in a tit for tat like a six year old would.

If you drop somebody home and they refuse to pay, what do you do? Do you call the guards or break one of their windows and enjoy the look on their face?

It's funny how people mention instructions, wonder why it is that (sometimes) when I get a drunker than normal person in the car and I tell them and anyone with them to let them sit on the passenger side rather than the middle or driver side of the vehicle they have a tendency to argue, even when you explain to them that if they start getting sick it's easier and safer to open the passenger side door than the rear driver side door to get out in a hurry they'll still argue with you.....

Anyways as to the general consensus of this thread until you've had to deal with inebriated people in a taxi who think they can lord it over you, you'd never actually understand, hence why I will often put inebriated people out of the taxi or not even let them in at all.

You wanna ride in my taxi, you prove that you have the respect for other peoples property that I deem as a requisite

    Well said Spook.
Its hard enough driving a taxi let alone having to deal with drunks and those who want to argue over everything from opening the windows to having the radio blaring as loud as it can go!
I dont like to turn down work especially as it is hard enough to make a living at this game but I have now started to avoid certain people e.g. those trying to hail me waving bottles or pint glasses with alcohol in them and the latest craze here in Ballina seems to be to jump out in front of a taxi forcing the driver to brake suddenly. I really wish that punters would realise that a taxi with no roof sign lit is not for hire and the driver has passengers in it or is on the way to do a pick up.
I came very close to having a serious accident on Saturday night with a scumbag who forced me into stopping in the middle of the road and arguing because I would not pick him up. He was that drunk he could not see that I had people in the car.
People are drinking way too much and have no control over themselves. It has gone way out of hand. Twice over the last two months I have had two people who pissed on the car seat.
People are drinking in the house before they come out on a Saturday night more than likely drinking double and triple measures of spirits. Then an hour or two later these same people are what I can only describe as absolutely hammered and its us taxi drivers that have to deal with them.
I avoided a puker myself three weeks ago as I could see him in the rear view mirror. The first sign was that he was full of chat when he got in and then silence plus a gurgle or two. I pulled over and asked him to step out and get some air. And thankfully for me just in time. The minute he got out he spewed all over the place.
People do not realise the havoc this causes to a driver especially at the weekend trying to get a car valeted or if they have the stomach for it (and I most certainly don't) clean it themselves. There is no worse smell than vomit and it seems to linger for ages and you really need the services of a professional valeter and the whole car needs to be cleaned.
No driver is going to risk a puker and will pull over immediately and let the punter out.

Based on her descriptions of the evening's events here, any lawyer worth their salt would tear her apart in court.
