    Hey there, just spotted a lovely site with no planning permission 1 mile from where I'm from. However I'm afraid to purchase this site as my home house is actually just inside the border of the local town so think I may be classed as being from the town. Although it's only one mile away would I be classed as a local and be granted planning? I work ten miles away from this site. Anybody ever been in the same scenario or know anything? Any help much appreciated. The site is going sell very quick as there's lots of interest in it.

    First of all, it's not a site if it doesn't have planning permission, it's just an agricultural field.

    The local Development Plan will give you the low down on who 'qualifies' to build in the area. Check on the Development Plan if there is a sterilisation area around the zoned areas of a town or village. If there is the 'site' could be within this area, stopping any type of development for most people.

    The fact that you are from a 'settlement' area could prevent you from living in a rural area, it certainly will limit you, again the Development Plan should guide you here.

    Thanks for your reply.. Should I be looking at the developmental plan for the town or that particular county? What section would it come under? Any body else know any more? It's all very confusing!

    If the town has a development plan, you should check the settlement strategy or housing policy on it. If it doesn't, the county one covers it. You'll probably find that they are similar anyway.

    Look up 'map viewer' on myplan.ie - this will let you know if the 'town' has its own area action plan or town plan or whether its just part of overall county development plan

    ... and regardless of what the development plan says, there are no guarantees with planning. Put in an offer for the site/field if you want to secure it, but make sure the sale is subject to grant of planning permission, and make sure your deposit is refundable if you don't get planning. This is very common, around my area anyway.
