Damage to vehicle in apartment underground car park

    I’m hoping for some advice from you guys if you would. To make a very long story short, someone tried to steal my motorbike which was in the underground carpark of my apartment block. We have secure parking with huge big electric gates with a beeper to get in and out. But the CCTV simply walked up to the gates and gave them a little push and they opened wide. They did not steal my bike but they did 1k’s worth of damage.

    The thing is that the management company have dealt with this terribly. Turns out there have been loads of break ins and robberies, and nothing has been sent out to notify any of the tenants. If I had of known I would have moved my bike to a more secure place. They knew about all this and they also knew the gates were not secure – but no warning was given to residents and now I’m a grand out of pocket.

    There is one of those signs on the wall saying 'park at your own risk' etc – does that completely get them off the hook or is there anything I can do to to get them to pay for some or all of the damage at all? Considering how lax they were, and that this could have been avoided, I think they should compensate me..

    Is it worth perusing or am I wasting my time?

    Notwithstanding the sign its probably a waste of time. If you're an owner then you're part of the management company and you should be giving yourself as well as the directors a bollocking for not being more pro-active about this sort of thing.

    I'd be asking for a EGM or bringing it up at the AGM and getting myself elected on to the board and making sure things are done properly.

    If you're renting then perhaps have a chat to the Landlord about why the BoD aren't up to snuff.

    No get or security system is 100% secure. None ever can be, without a massive cost.

    While unfortunate for you, the management company are not liable for the damage.

    You can certainly raise the issue with the management agent, the directors of the management company and also with your fellow members of the management company, but this can not totally secure your property. That's why we all must have insurance (contents insurance, vehicle insurance, etc).
