Notice during paid leave?

    I will be on 6 weeks paid leave from January after my current maternity leave ends but don't intend on going back. I have been told by the HR dept that there is no minimum time to return to work after receiving maternity pay so am presuming that means I won't owe them the maternity pay back. The thing is that my HR dept are not very good at communicating with me about not returning to work and time is fast running out. Want I'm wondering is, we have agreed for me to be on paid leave so I can use up holidays before returning to work but while I'm on paid leave can I hand in my 2 weeks notice and still stay on paid leave to cover the 2 weeks or is that a company matter?

    OP, leave entitlement is accrued during the year and is based on the amount of time worked, your maternity leave does not effect this. Most companies work on a January 1st to December 31st working year and are not required to hold over leave days to the following year. If you are using the leave in January based on the days you will work in 2013 ( if you are, your employer is very generous), then if you hand in your notice before you have actually worked in 2013 and therefore accrued leave entitlement, you may be required to return the leave payments in their entirety to your employer, after 6 weeks that might be a hefty amount to have to payback.

    Effectively you would be paid for holidays you would not be entitled too, but your contract will clarify this. Are you sure it is paid leave and not unpaid?

    Just hand in notice after week four, the six weeks are owed to you.
