Dangerous driving prosecution

    My 29 yo brother was stopped by gardai whilst driving and accused of racing another car and dangerous driving.He is due in court in January having received three separate summonses for the same thing over a distance of a few kilometers. His solicitor told him as its his first offence he would be charged with one of the offences if he pleaded guilty and not lose his licence. When he went up to the office to pay his fee the legal executive in the office told him he will lose licence and could be jailed. who is right?

    Your question is a rhetorical one. I suggest that you re-read your post and evaluate the status of the persons/actors you mention therein.

    A solicitor giving advice, is usually a person practicing in a specific area of law, or just generally. A trainee/legal executive on the other hand - is not (that doesn't mean that they're wrong).

    That said, like anything concerning the Road Traffic Acts and criminal sanction, most come with a punitive and possible custodial element.
