Land Transfer question

    Hi all.

    Can anyone tell me if the Land Registry transfers land into another person’s name on the basis of a title transfer dated 1991 in which there was no land size on the title document and the land maps supplied were later drawn up in 2005 and also the person who gave the land passed away in 1999 but the Land Registry went ahead and transferred the land anyway. Even though they were told they should not do this.

    Can this transaction be overturned ?

    Who told the land registry not to register? When was the application lodged with the land registry?

    Other members of the family informed the Land Registry. Application was logged back in 2005.

    There is a present query in relation to a transaction which took place more than 20 years ago. The lapse of time is not helpful.

    The land registry registers dealings. It is not the arbiter of whether a transaction is valid or not. If a dealing is presented in accordance with Land Registry rules, the Land Registry has to go ahead and register, generally. In any event, it seems that the registration has now been completed.

    You state that the dealing was registered after the person who transferred the land had died. I can't see the relevance of this once the transfer took place while the transferor was alive.

    You also mention a map, which post-dates the 1991 transfer. We have not been told whether the map is correct or not.

    Perhaps there is a contract or agreement for the transfer of the land, which could give all of the relevant details of the transaction.

    I imagine that if this thread progresses, it will become a request for legal advice rather than a legal discussion, so I would suggest that you should see a solicitor and ask him to take up a copy of all of the relevant papers, so that he can advise you properly.

    Who told them they shouldn't ?

    Maps in the land registry arn't in any way conclusive evidence of title to anything.

    1999 ? Sounds like a long time ago. Statute of limitations and what not.

    Actually, please just go a to a solicitor. You can't seriously expect people on the internet to give you anything valuable on this question.
