The Gardi entered the house unlawfully ???
The driver was not told and giving no details where the car was.

How did the Garda enter unlawfully? Were you present?

I'd take more notice of your post if it wasn't your first one on a brand new account created for the purpose.

The Gards must've been invited in. Unless they broke the door down, then how did they get in?

I'm not sure of a dismissal in this case. I think the driver has a cheek going for a dismissal, and book should be thrown at the driver and rightly so. To drink and drive is unforgivable. Thank God the only damage caused was material and no-one was hurt.

The driver sounds like a prick and i hope he gets prosecuted to the fullest extent of the law. There is no excuse for that sort of behaviour as you are playing with other peoples lives. Im disgusted by this.

Hi, A car was driven one night by a driver who was intoxicated and crashed into a wall causing damage. The car was driven back to the house (which was less then 30 seconds drive). On the way met a garda van in the estate it was crashed in and drove past them, the car was finally parked back in the driveway of the house and the driver went upstairs. a few seconds later the garda van pulled up at the house, came into the house(unlawfully??), brought the driver outside, Impounded the car and was then arrested

Are they any grounds that the case might be dismissed because:

The driver was not caught in the vehical
The Gardi do not have the keys of the vechical
The Gardi entered the house unlawfully ???
The driver was not told and giving no details where the car was.

The guards probably saw the driver in the car, driving.

AFAIK, Guards can enter a house without consent if they believe somebody inside has committed an offence or is wanted.

Perhaps it was the scare he needed to change his ways before he killed somebody.

OP was this person breathalysed ? Asked if he was the driver ? Cautioned ? When ?

hopefully an independent witness will appear and give a statement thereby cementing the case even further.
