What is "Deed of assent"?

    hello folks,

    Father died and the house and land will be divided up. I am executer. I have all the maps etc. I have almost completed probate without a solicitor and this is running well so far. However legally, for the land an house transfer, do I need a solicitor? Can it be done by me by deed of assent?

    You need a solicitor for the conveyance. You also posted this before. Get in person, proper legal advice or you risk defective title.

    You can certainly draw up your own deed of assent, if you know how. Nobody can advise you on this, though, (for pay or for free) unless are a solicitor; it's an offence to offer advice on this if you don't have the appropriate professional qualification.

    OP, I did personal probate a few years ago but when it came to the property I adopted a 'hands off' attitude. That is definitely something best left to the professionals.

    If the house is going to one person then it's not absolutely necessary to transfer the title straight away. In my case a relative was left an apartment but he only got the title transferred a year after the grant of probate because he needed to take out a mortgage on the property to raise a loan and naturally the mortgage required that the property was in his name so at that stage he employed a solicitor to get the title transferred.

    Tom, actually I posted this twice before, but you never replied. And each time immediately after posting the thread was closed without so much as an explanation? Asking if I need A solicitor or not for something is hardly looking for legal advice is it! Even if it was, a polite explanation for the thread closure would be a little more mannerly. You may now comment and close the thread.
