Claiming tax back on college fees, then getting full fee refund

I paid full third level tuition fees this year and should be eligible for about €1,000 tax back from it.
I however felt that I should not have had to pay those fees and I currently have the office of the ombudsman investigating. If that investigation goes the way I hope it will, I should get a full refund of all fees paid.

The issue is this: If I claim tax back, but then subsequently get a refund on all fees, where do I stand?

I'd imagine I'd have to return the claimed tax back to Revenue, but is that even possible?

    Revenue will always take money.

If you don't pay, the risk is that you get done for tax fraud.

    Are you working?

Fee relief is a relief against PAYE paid.

    No PAYE no refund.
