    I would like to hear from separated or divorced mothers whose Child Benefit has been cut off because their ex-husband has made a false claim to the Social Welfare Department.

    Why was it cut off? Do you have primary custody of the children??

    Surely there must be a way of appealing this - no?

    It was cut off because my ex told them that my children live with him, which is a complete lie. it is suspended pending an investigation. The world is upside down!

    All you would have to do is show them the court order then. Job done!

    It is a bit more complicated than that, we have joint custody

    From the CB guidelines:
    Child Living Full-Time With Mother/Step-Mother
    Child Benefit is paid to the mother (or step-mother).

    Child Living Full-Time With Father/Step-Father Only
    Child Benefit is paid to the father (or step-father).

    Child Not Residing Full-Time With Either Parent
    Parents residing in separate households
    Child Benefit is payable to the parent with whom the child resides the majority of the time. If the child resides 50% of the time with each parent, the mother is paid.

    Therefore, if there is joint custody, and both parties are claiming to have the children more than 50% of the time, then it would only be correct to investigate who should receive the payment.
    You need to outline the exact times you have the care of the children, i.e. From Sunday at 8 p.m. until Wednesday at 7:30p.m. and from Thursday at 5p.m. until Friday at 5p.m - or whatever your own circumstances are. Joint custody can only be on paper at times - its the amount of time the children actually spend in your care that counts.
    Then see what percentage of the week you have them for (there are 168 hours in the week).
