2.5 Acres of Land.. whats it worth??

    What are the thoughts or opinions on the following. Right here is the story, we have or should i say had a right to use an unmanned railway crossing in the neighbours land of which we had approximately 14 acres and he had 2.5 acres on the opposite side of the tracks. There is a very narrow low bridge underneath the tracks in our land for access to the land. About 10 years ago the neighbour sold the right to use the crossing back to CIE without notifiying us, well neither party notified us of there intention to sell the right or to close the crossing. The crossing is now closed and CIE own the 2.5 acres, for the past 10 years or so we have not been able to maintain this land, we used to be able to get hay or silage off this ground and grazy sheep on it. Sheep will not use the narrow access bridge, we are only able to graze cows on this land as they are reasonable quiet and will use the bridge. The land is part of the flood plain to the river suck and so floods from time to time but that was never a problem and was dealt with. The 2.5 acres are a triangular field that is bordered on one side by a small river, the other side by the railway line and the third side by our land with the only access through our land via a small narrow low bridge underneath the railway tracks.

    Thing is CIE now have the nerve to offer us this land as first preference to buy off them for a reasonable price. What do ye think and do ye think if it went to public auction would it be sold. It is off no use to us as we cannot access it with a tractor to maintain it same as our own land because of CIE's and our neighbours lack of communication 10 years ago. The crossing should never have been closes without our consent. Have any of ye came across some thing similar in another part of the country?

    More than likly you would be the only bidders at auction. You could always make an offer to them. Your other choice is to farm it away yourselves and claim sqautters rights down the line if they fail to evict you however for state land this takes 25 years.

    I be more inclined to make an offer, 500euro/acre and see what they say. It seems to be the case that you are the only person that can buy it. nothing ventured nothing gained.

    What was the nature of the right? Was it simply permission to use it, or had you an actual right of way?

    Thanks for the replies lads. As regards the right of way, iam not sure what the status of these were. I suppose it was an agreement between both parties to use the crossing when the line was first built but that was way before my time or my Dads time for that matter, iam not even sure when the Dublin to Westport line was built. We also sold the rights to a crossing about 2 mile further down the line which also another neighbour used but it was agreed by ourselves and the neighbour to sell this right as the land was of little use due to poor access and not being able to improve the access. The crossing that was sold that we didnt agree to has great access due to CIE spending a fortune improving it and then the rights to be sold by the neighbour incidentally, this neighbour in question didnt always own the lad he was left it in a will, so there was probably the start of the problem.

    On regards the price per acre, we have offered 25 quid per acre and told them if they get a better price to come back to us. To be honest we have been messed around alot by CIE and by our neighbour with regard to this whole mess for the past 10 years. If they open the access well then it would be worth 500 per acre but i dont think it is at present.

    If some one who knows about these railway crossings and what rights that went with them would post some advice or an opinion it would be greatly appreicated. Thanks lads.
