How long does a solicitor have to register a mortgage as a burden on a folio?

    Hi,
    Looking for an answer to this question, as I'm studying in detail mortgage law for the winter months.

    Suppose a borrower signs the standard Law Society residential mortgage lending undertaking and completes all the formalities looking for a "Top Up" mortgage (Legal Mortgage/Registered Title) on their house during the boom, say 2007. How long does the solicitor have to register that mortgage as an additional burden on the folio of the subject property? If he had somehow forgotten to register it, how long after the borrower signing all the documents does the borrowers solicitor have to register the mortgage......

    Funny how mistakes can happen during the boom time administration of loans. Is there any time limit that applies here, or will be documentation be accepted at any future date by the Land Reg?

    I don't think that there is any time limit as such, but complications can arise if registration is unduly delayed.

    You could ring the Property Registration Authority and ask them to make sure, or check the PRA rules.
