Car Insurance No Claims Bonus query

    about 18 months ago i was hit by an uninsured driver,

    as it turns out the car was insured but the person who was driving it was not insured to drive it,

    So through the MIBI i got back most of my claim From the Insurance company as they insured the car but not the Driver

    But as i had to use my Comprehensive insurance to get the Car on the road, this effected my No Claims Bonus, ie so this then was down on my no claims bonus as a Claim, Which messed me around when i went to change insurance companies , which meant i had to stay with them

    It turns out now i have recieved a email from Mibi saying the following : that i should get in Touch with Allianz and ask them to re issue me with a corrected No Claims Bonus as this claim should not appear on your NO Claims Bonus as per the MIBI Agreement.

    Is this correct and now i will be able to shop around?
    Unfortunately at the moment Allianz are not answering my Emails or returning calls , can i go to a Insurance Ombusdman ?

    Just a quick reply as I don't know the full ins and outs of it........

    I was told by a friend who works in the Insurance industry about the MIBI protocol where by you are allowed to claim from your own insurance, like in your case, and it won't ruin you No Claims Bonus as there was a current MIBI case going on.

    From what you're saying sounds a lot like what I heard before from someone in the know so I'm gonna stick my neck out and say that you shouldn't lose your No Claims Bonus........I'm open to correction though!

    Where the damaged vehicle is comprehensively insured or where the damaged property is covered under a policy of insurance, the MIBI Agreement stipulates that the claim must be dealt with by the insurer of the vehicle or property.

    A No Claims Discount Protocol operates between MIBI and the insurers which guarantees protection of the No Claims Bonus where the comprehensive insurer compensates the policyholder on behalf of MIBI.
