divorce/seperation info?

    hi , can anyone post a link or direct me to where i can find info on separationor divorce proceedings and property rights . i will see a solictior also
    but would like to read up on it first

    Hi,

    Need some advise for a family member re: seperation.

    Basically, his wife has left with children to live with a new man, she has taking all savings (they had 2 bank accounts his and hers - his they used for rent, food, bills etc hers they only used for holidays so she had a large amount in her account) and also wants him to pay maintanence. She has also said she wants to get a divorce aspa.

    He does not want a divorce - he is willing to forgive and take her back and even if she does not want to come back he is a devoute cathloic and sees divorce as a grave sin.

    I'm looking through the links in the citizensinfo site but if any one can give some simple advise I'd really appricate it.

    My wife wants to take him to a solicitor just to be prepared but we have no idea what to ask when we go?

    Irish divorce is "no fault" , i.e. if you want it you get it, subject to certain conditions.
    If he goes to a family law solicitor all will be explained, if he can't afford one, apply for legal aid at his local Law Centre.

    Thanks for the reply, I'll try and find a good family law solicitor in my area.

    Can you explain the "no fault" some more please. What happens if one person wants a divorce but the other doesn't?

    They don't own a house but do own land, what would liekly happen here?
    Also child maint - is there a min or max amount he would have to contribute (even though she has taken all their savings)?

    No fault means just that neither party has to prove it was either parties fault (adultery etc.). No one can answer the property and money question as each case is different.
