Change employment t&c without warning.

    Hi,
    quick question if I may. Recently started employment and was informed that pay terms were hourly rate with overtime at normal rates. Verbal agreement, which company are not denying that it was the agreement. All happy.

    Work started and 6 weeks in t&c change to salary, with no paid overtime. Not happy now.

    Now to compound the problem, all overtime done and paid for, circa 40 hours, is to be paid back. They took half back today and other half back next week. No warning of action given in writing.

    2 questions are:

    1: Can company change t&c just like that, like it or lump it basis?

    2: Have they the right to claw back already paid out monies from my wage and moreover, without written warning of such?

    If I could get S.I. reference most grateful. Have Payment of Wages Act 1991 and Working Time Act 1997 to hand via irishstatutebook.ie
