Road traffic accident

    my partner was involved in road traffic accident. he was driving in bus lane and approaching an accident on hard shoulder so he slowed down. another driver in lane to his right was rubber necking and to avoid rear ending car in front swerved out into the bus lane crashing into him and causing him to crash into the car in the other accident.

    The driver in the car admitted responsibility at the scene. My partners car is a write off.
    he contacted the guys insurance and he is now not admitting liability and he also wont make statement to the guards.

    What options are open to my partner as he is without a car now and needs it for work

    That's what insurance companies are for.

    I presume he was in the buslane because he is a taxi driver.

    Insurance companies will never admit responsibility like that, and will advise you to do the same. You should never immediatly admit liability. If he is not a taxi driver then they may have a good case to argue that he shouldn't of been there and he was breaking the law.

    he is a taxi driver and the garda who was at the scene for the other accident saw it happen

    You should be fine then, but dont expect it to go quickly and smoothly, thats just the way insurance companies work. Your best bet is to get on to your insurance and get them to fight on your behalf, they'll have more clout with the other insurance company.

    I'm not at all sure why you're posting here OP.

    A Garda witness. Admission of liability on site.

    Go off now and tell your 'partner' to speak to his insurance co and let them deal with it.

    1. Co-operate with any garda investigation in the usual way.

    2. Instruct a solicitor to start the process of a claim against the Defendant.

    3. Don't expect that to resolve next week or next month. Your partner will on success in the claim be compensated for all loss. A solicitor will advise as to whether he should go an replace his vehicle for work purposes (based on a duty to mitigate loss).

    Thankfully it seems he wasn't injured - small mercies & could have been worse etc.
