    Hi,

    Quick question hoping somebody can answer me. My aunt passed away 4 years ago and her estate has gone through probate, etc. Her solicitor has been paid for this by the immediate beneficiaries 2 years ago. Her husband has the lifetime of the farm and on his death (hopefully not for a good few years yet), the farm is to be auctioned and then remaining beneficiaries to be paid out.

    Does her solicitor have to be involved in the sale of this or can the executor decide to go with another solicitor?

    The executor can use any solicitor he chooses.

    A lot of solicitors will draw up a will which says that the executor should use XXX firm of solicitors - usually (no surprise) the same firm which drew up the will. The provision (in the will) can be totally ignored.
