    Hi All,

    Im hoping for a little bit of help here or some advice.
    I recently moved out of a house share with another girl. We had rented the house for a 6 month period after which we decided to go seperate ways as she was transferred for work.
    Anyway the letting agency decided not to give us back our deposit because only one of us had written the letter to say that we were handing in our notice. But i had confirmed on the phone that we were leaving. I thought that this letter would of covered us both.
    Anyway the other girl has demanded that I Pay her back her half of the deposit as she says thats its my fault that we didnt get it back. She has actually turned very nasty about this and has even called my parents and demanded money from them also.
    I'm not sure what I should do aabout this.

    Any help would be so appreciated as this is hanging over me and starting to get to me.

    Get in touch with threshold about the unreturned deposit, only one tenant needs to sign a letter giving notice on behalf of all the tenants. As for the ex housemate who's after her money, try to make clear to her that the dispute is with the agency, not you.

    I would have thought that if a landlord treats two lodgers seperately for the purpose of notice he should also be treating them seperately for the purpose of the deposit. But I suppose it depends on the agreement.

    Thanks for your replies everyone.

    What Im wondering is that we both signed the lease seperatley and each paid our deposits so does that not mean that she should get on to the tenancy agent and get her own deposit back instead of harrassing me. If I cant get mine back i'll accept that but I dont feel that i should pay her out of my own money.
    I completely understand that she's quite annoyed at them for holding it and I'm very upset that she has turned so nasty towards me as we were very good friends before all this.

    All i need to know is if im right for telling her to see the agents herself about her own deposit.

    You would both have to sign the lease, but it's an agency renting the whole house, and they have deemed the notice served invalid for both, notice however only needs to be signed by one tenant on behalf of all the tenants in a property so the notice should be valid for both. As I said Threshold can help out but I wouldn't let it go, enforce your rights and both of you should get your deposit back. As for the personal situation, she sounds unreasonable so I wouldn't worry too much about her, you owe her nothing,, but it's the agency you both need to be dealing with.

    This seems very sharp practice by the letting agency. Call Liveline ( Joe Duffy) . Amazing how a call from their office sorts things out. They like to give both sides a chance to resolve matters before they put you on air. You won't have to go on air I reckon ... the bad press wont be worth the hassle - they'll settle! !

    I'd also get in touch with the PRTB, if the letting agency is going to claim the notice wasn't valid they are supposed to inform the PRTB I believe.

    That's presuming the property is on it ;-) worth checking online methinks ..
