    If a person received a "settlement + expenses" and only got the "settlement portion, where do they stand?

    They'd probably be standing somewhere near the CCJ, with their solicitor, who advises them on such things.

    Maybe I wasn't clear enough, sorry.
    Their solicitor has given them their settlement portion but has not given the expenses(which their solicitor has all receipts etc pertaining to the expense side of the claim).

    The claimants solicitor is trying to say there are no expenses to be paid even though that was part of the settlement ie settlement + expenses.

    A settlement is made up usually of 3 parts general damages, special damAges and finally costs. When a matter is usually settled general and special damages are added together and costs are the plus. General damages are to put it simply pain and suffering while special damages are loss of income and medical expenses. Costs cover a portion of your legal costs and expert reports. If a cheque has come from the defence for damages it would usually cover both general and special damages and a speperate cheque would then cover costs.

    Thanks for the reply!
    Legal costs were paid for by the claimant from the settlement portion that they received and the claimant has never heard about any additional additional monies or cheques after the settlement.
