Oh the joys... inaccurate, undeserved fixed penalty notice, again.

    I'M sure at least one person on here has encountered this at least once. It's getting to be a sick joke at this stage.

    On friday evening i received a fixed penalty notice for exceeding the speed limit, in a car that was destroyed by fire in 2008 and is now baled, on a road i was approximately 200km away from.
    To top it off the reg written on the letter is the reg of my old vehicle which will never see road again, but the reg of the actual car caught is shown in the photo and it's one number out. Instead of reading XX-lk-xx03 the actual car caught reads xx-lk-xx01.
    The fine is also dated 1/10/12 and i only received it last on friday.
    The garda processing office is closed until tuesday so now i have to wait and probably call while I'm at work on tuesday.

    I believe i should be able to get this undone but having never had to do this particular one before i'm unsure how much hassle it's going to be but i presume it will be a lot.

    I've had two mistaken fines for toll roads too and a completely ridiculous threatening letter for a car that wasnt even mine or in use by me being towed and impounded

    Leave it. Do nothing. Let them bring you to court and then advise them of their mistake.

    That doesn't sound like a great plan, plus in my current work situation i can't afford days off to go to court. I also greatly dislike courts and would rather not go unless i had to.

    I am sick of people coming on here looking for ways to weasle out of points, trying to blame simple technicalities. So what if the car was destroyed 4 years ago and you were 200KM away????

    Just ring them and make them aware of the error. It's that simple.

    Well i will be doing that but can't do it until tuesday and i'm just annoyed at this BS. Also hoping it won't take to long to sort out. It's ridiculous that the idiot who processed it couldn't even type in the correct registration.
    The correct registration is clearly shown in the picture and it's on a BMW not a ford.

    As for the rest of the posts... i see boards is just as annoying as ever.

    I agree with poster above who said this is a very poor advice and a very bad idea. Anyone who knowingly allows a court case to proceed while possessing information that could prevent it is likely to have have judicial spleen vented all over them. Wasting court time, abuse of process, etc

    Indeed, seeing as i'm right in the first place (they got the details wrong, sending me an undeserved fine), I don't want to just do something that will cause me any more hassle on top of this. Any sensible person would surely assume that leaving it and doing nothing until summonsed to court would make me look bad and cause people to be less positive or helpful in dealing with it.

    i read it as a joke too Conrad... it is a joke really isn't it? You'd think they'd check they're own photo before giving you points and a fine....time wasters!

    Yes, a joke, but an unhelpful, trouble making interjection as is made by so many people on this site, including some of the more questionable moderators.

    It's quite inconvenient and very annoying. Anything that i need to do about it is going to cost me time, money and effort that i should not have to spend on it.

    I apologise whole-heartedly for my unhelpful, trouble making interjection. I did not realise the pain and suffering it might cause such a sensitive soul. I can only hope you reported my post, in which case I am sure I will be dealt with by our questionable moderators.

    Couple of years ago I got a fixed fine etc in the post, saying I was doing 43mph on a 30 mph road.

    I wasn't on the road at that time, as a matter of fact, I was at work. Talking to a member of the Gardai regarding a shoplifter.

    I rang my local station querying this, they told me to send a letter into the station. 2 weeks later I got a letter apologizing for the error and telling me the matter was closed.

    Simples.

    Make/history of vehicle is irrelevant - all that matters is the licence plate. Seems like the camera is picking up the 1 as a 3; it's an automated system, don't think there'd be anyone typing any reg plate numbers. Doubt it's feasible. Camera picks it up, reg plate number generated and letter results. Is the 3 in the image in any way smudged? Bolts close to it maybe? It's strange all right - e.g. an 8 would be more understandable, but a 1 bears no resemblance to a 3. And yeh you're right not to take the "legal advice" (I don't get why some so confidently recommend the ignoring strategy; even if you're not in the wrong, ignoring it will still make things worse - they don't know any better and it's far more beneficial to yourself to make them aware).
    I can understand your annoyance but it's not personal and not done to target you, single you out and cause you a hard time so just bear that in mind when contacting them - it certainly won't be the fault of the person on the phone. For some reason your plate is being picked up as someone else's and it's an automated error and very frustrating no doubt, so the way to prevent this happening is to have your name/address as registered owner removed from the written-off car - you're obviously still on record as same. An insurance report might help speed up this process.

    I found the fixed penalty office (it's in Thurles) very helpful when I managed to wriggle out of my speeding ticket, was being done for over 80 in a HGV which my 101 isn't. After an initial phone call I sent the proof by post and email and it was cancelled quickly.

    Then don't bother ringing them, stick a letter with in explaining it is not your car and post it back. Keep a copy of everything just in case.

    Mistakes are made, it happens in life. All you will be out is a stamp. There are bigger things in life to worry about.

    Get on to the motor tax people to get your details removed from the 08 vehicle as registered owner.
