    Right firstly I am not advocating fraud or looking for advice on how to defraud the system I am asking a question for a relative of mine in a bit of an awkward situation

    Herself and her partner are both in receipt of JSA and RS they have one child.

    He recently got casual labour, SWO told him they would not give him XO dockets and to drop a letter in stating hours worked and amount earned once work finished and they would sort it out.

    While he is working all the money he earns he is keeping, but still paying his portion of rent and utility bills. No money is being given to her for food or the house. She is still collecting her JSA as is he, he also receives RS.

    Now here is the problem, she wants to go back to social and tell them what is going on as this has been going on a number of weeks now, he wont do this, she is also worried that if she does go back they will be cut off from everything leaving her broke as technically they are a co habiting couple yet their finances are completely separate...they are only living under the same roof for the child but the relationship is long over, however no way of proving this to social, he wont leave and as rent allowance is in his name she has no finances to move also she paid the deposit and mths rent in advance where they are now so would have to walk away from that which is nearly 2000 so not really a smart thing to do

    So what is the best way for her to deal with this situation as she is terrified if swo find out he is working and not declaring (which they told him not to do until work is finished, however its going on a lot longer than anticipated) then they will be cut off completely leaving her with only child benefit.

    Before you all ask yes she is actively seeking employment but it needs to cover child care if she does get work as well as rent, bills, food and work expensive's

    She is out of her head and I really havent a clue what to say to her, and she is terrified to approach the swo.

    You say he wontleave, but why doesn't she? It sounds like a very unhealthy situation to be in. She should extradite herself

    The SW will look more favourably on a parent and child than an independant adult. The deposit should be in her name as she paid it so in the event of moving she should get it back. Also if he isn't paying for food etc he shouldn't get any.

    Not really sure of the ins and outs of it tbh dont know her that well just ran into her and she look a bit upset so had a coffee and a chat

    anyway thanks for the replies, from what I got from her I think she is tied into a lease with him hence why they are still living under same roof and he gets the RS, as for her deposit I have no idea if she has a receipt and if it is for her only, I can only reference it to my own life and me and the OH have a rent book saying we paid x amount in depoist and mths rent in adv, when actually I paid mths rent in adv and he paid deposit but it doesnt differentiate so I can only presume the deposit would be signed to both of them if both are on the lease but I am just thinking outside the box on this one tbh. I dont think they are living where they are that long so no idea how long left on lease but dont see how she could just leave without loosing deposit as we all know from the accommodation threads on here so I guess her hands are tied in that sense.

    Anyway not much I can say to her I dont think, other than to sit down with yer man and have a chat, they may not be together but they do have a relationship due to their little girl so again I can only presume they speak as other than that it would be a very uncomfortable house and I didnt get that impression off her.

    Anyway who knows just thought I would sound off on here see if any suggestion came up about what to do/say to social welfare regarding him working, so will leave it at that
